Sweepstakes Name: Nissan of Fort Pierce Ultimate Giveaway Sweepstakes (the “Sweepstakes”).

Sweepstakes Dates: Registration will take place beginning at 12:00:00am ET on 8/28/2023, and ending at 11:59:59 pm ET on 11/17/2023 (the “Registration Period”). The grand prize drawing event is scheduled to occur at approximately 1:00 pm ET on 11/18/2023 at Nissan of Fort Pierce 4815 South Us-1, Fort Pierce, FL 34982 Sponsor and appointed contest administration shall be the sole keeper of the official time clock. The Sweepstakes is subject to all applicable federal, state and local laws and regulations. Void outside of Florida, and wherever restricted or prohibited by law.

Who May Enter: Sweepstakes is open only to legal U.S. residents of Florida, who are age 18 years of age or older as of date of entry, and who possess a valid U.S. driver’s license, except the following classes of persons are not eligible to enter, participate or win:

Employees, officers, and directors of Nissan of Fort Pierce (the “Sponsor”), Tropic Survival Advertising & Marketing (the “Administrator”), each of their respective franchisees, affiliated companies, subsidiaries, distributors, retailers, printers, advertising and promotion agencies, and any and all other companies associated with the design or execution of this promotion (collectively, “Released Parties”) and the members of the immediate families or households of any of the above, whether or not related. “Immediate family members” includes, for purposes of this promotion, parents (including in-laws), grandparents, siblings (including step-siblings), children (including step-children), grandchildren (including step grandchildren) and each of their respective spouses.
Individuals who do not have access to an internet connection in order to visit the contest website, or a valid email address to register, or who are unable or unwilling to be present in person for the grand prize drawing event scheduled to occur on 11/18/2023.

How to Enter: Visit https://campaign.nissanoffortpierce.com/ during the Registration Period and fully complete the entry form with all required information including name, complete address, valid email address, birth date, and phone number(s). After having read and agreed to these Official Rules, click the submit button to submit your online entry. All entries must be fully complete for all required information, and must be received by 11:59:59pm ET on 11/17/2023 to be eligible. Any contestant submitting more than one entry per valid email address will void all entries by that contestant.

Maximum of one entry per person. No one may participate or register on behalf of another individual. Any individual who does not meet the eligibility requirements, does not wish to participate in the grand prize contest or is unable to attend the grand prize contest event (see below) will be disqualified. Each eligible contestant must submit an entry on his/her own behalf. Entries in the Sweepstakes are not eligible to be transferred to any other individual. Any entry submitted on behalf of another individual or using another person’s name or email address, or providing any false email addresses or information, will be disqualified and ineligible to claim any prize. Any attempt by any participant to obtain more than the stated number of entries allowed by using same, multiple/different emails, identities, or any other methods void that participant’s entries and that participant may be disqualified.

By registering to enter and participate in the Sweepstakes, you affirm that you have read and accepted these Official Sweepstakes Rules. All entrants agree to be bound by and abide by the official rules of the Sweepstakes. All entries received become the property of the Sponsor and will not be returned.

Grand Prize Drawing Event: All eligible contestants who completed an online entry are invited to the Grand Prize Event at Nissan of Fort Pierce on 11/18/2023 starting at 1:00 pm ET. Sponsor reserves the right in its sole discretion to change the date, time or location of each grand prize drawing event. In order to be officially entered into the Grand Prize drawing on 11/18/2023, qualified registrants must be present in person at the grand prize contest event for a chance to participate in the grand prize drawing. Each qualified registrant must be present in person. Participation is non-transferable, and no individual will be allowed to participate on behalf of a qualified registrant.

During the Grand Prize Event, the Administrator shall conduct a random drawing from among all eligible entries received to randomly determine the potential grand prize winner. The potential grand prize winner must be present at the time of their selection and announcement in order to be eligible to claim the grand prize.

The selected potential grand prize winner must immediately make their presence known to the Sponsor, within the designated time limit as announced and determined by the Sponsor. Any potential grand prize winner who fails to make their presence known within the required time period as solely designated and determined by Administrator in its sole discretion, who is not present at the time of their selection and announcement, or who is ineligible or does not wish to accept the grand prize will be disqualified. An alternate potential grand prize winner will then be selected from all remaining eligible entries received and notified per the procedures outlined above. This process will continue until a Grand Prize Winner has been confirmed.

A maximum of one grand prize winner shall be selected and designated as the grand prize winner. Decisions of Administrator in the selection and determination of Grand Prize Winner are final. Difficulties with getting to location to enter or participate in the grand prize contest are not the responsibility of Sponsor or Administrator.

Prize Award & Delivery:

Grand Prize:The grand prize is the grand prize winner’s choice of any one of the following vehicles from Nissan of Fort Pierce:

One (1) 2023 Nissan Altima S with a maximum retail value not to exceed $27,325

One (1) 2023 Nissan Rogue SV with a maximum retail value not to exceed $31,150

One (1) 2023 Nissan Murano S with a maximum retail value not to exceed $36,210

Sponsor will solely designate and specify available vehicle including make, model, color and options for Grand Prize winner’s prize award. Grand Prize winner may not substitute, exchange, or apply the vehicle’s value towards a higher cost or alternate vehicle, except at the Sponsor’s sole discretion. Designated vehicle must be the Sponsor designated vehicle that is currently in designated dealer’s stock of inventory. Sponsor reserves the right to award an alternate year model if the aforementioned model is not available at the time of prize award.

If the designated prize vehicle MSRP is under the MSRP listed above, the winner will not be awarded the difference between the vehicle’s actual MSRP and MSRP listed above. Grand Prize winner is responsible for paying any and all sales tax on prize award at time of delivery.

All other costs and expenses related to prize acceptance and use not specified herein as being provided are the sole responsibility of Grand Prize winner, including but not limited to tax, title, insurance, license and registration fees. All income, federal, state and local taxes are Grand Prize winner’s sole responsibility. All grand prize awards are non-transferable and no cash redemption or prize substitution allowed, except at Sponsor’s sole discretion or as provided herein. Sponsor reserves the right to substitute a prize of comparable or greater value, at its sole discretion.

Winner must accept and take possession of grand prize from the designated dealer (or as otherwise specified by Sponsor) within 30 days of Grand Prize Event. Failure to collect or properly claim any prize in accordance with these rules will result in forfeiture of the prize. If unclaimed or forfeited for any reason, contestant will not receive any other prize substitution or compensation, and any unclaimed or forfeited prizes will be returned to the Sponsor. Sponsor may then decide to either award the prize using another method as determined solely by Sponsor, or Sponsor may elect not to award grand prize. Other restrictions may apply. All properly claimed prizes will be awarded. A maximum (1) grand prize will be awarded.

Bonus Prize:

Any eligible registrant who enters the contest and shares the Sweepstakes site via the designated social media platform(s) as instructed on the Sweepstakes site will earn one (1) entry into the Bonus Prize Giveaways (the “Bonus Prize Entry”). Maximum of one (1) one Bonus Prize Entry per person.

A random drawing will be held on 11/18/2023 at 1pm ET to determine the Bonus Prize winners. Potential Bonus Prize winners must be present at the Nissan of Fort Pierce location during the drawing.
If a Potential Bonus Prize winner does not meet the eligibility requirements or elects to decline the prize, s/he will be disqualified and, at Sponsor’s discretion and time permitting, an alternate potential Bonus Prize winner will be randomly selected from among all remaining eligible entries and notified as per the procedures outlined above. Any disqualified entrant will not receive any alternate prize substitution or compensation.

Prize winner(s) will be required to complete and return a W-9 form (if prize value exceeds $600), affidavit of eligibility, and liability/publicity release, and present a valid U.S. driver’s license and social security card before prize will be awarded. Grand Prize Winner will be issued a 1099 form reflecting the value of the prize and is responsible for paying all income taxes on prize.

Additional Rules & Restrictions: By participating, entrants agree to abide by and be bound by the Official Rules and the decisions of the Sponsor and Administrator, which shall be final in all matters relating to this Sweepstakes. In the event an entrant wins a prize, and is later found to be in violation of these rules he/she will be required to forfeit the prize or to reimburse Sponsor for the stated value of the prize if such violation is discovered after winner has used the prize. Participation in Sweepstakes constitutes permission for the Sponsor and its designees to use entrants’ names, cities and states of residence and/or likenesses for purposes of advertising and trade in any and all media now or hereafter known worldwide on perpetuity without limitation or further compensation, notification or permission, unless prohibited by law. False, fraudulent or deceptive entries or acts shall render entrants ineligible for any prize.

By participating, entrants agree to hold all Released Parties harmless from any claims, losses, actions, or damages of any kind, whether actual, incidental or consequential, for injury (including but not limited to death), damages, losses or expenses arising out of or relating to entrant’s participation in this Sweepstakes, or the acceptance, possession or use/misuse of any prize, or participation in prize-related activities (including but not limited to travel or activity related thereto), and to assume all liability therefor.

Released Parties shall not be liable to winner or any other person for failure to supply the prize or any part thereof by reason of any acts of God, any actions, regulations, orders, or requests by any governmental entity, equipment failure, terrorist acts, war, fire, unusually severe weather, embargo, labor dispute or strike, labor or material shortage, transportation interruption of any kind, or any other cause beyond Released Parties’ sole control.

Participants are restricted to use of ordinary and typical computer equipment, mobile phone equipment, Internet access and cellular networks. Sponsor disclaims all liability for the inability of a participant to complete or continue an entry due to equipment malfunction, busy lines, inadvertent disconnections, acts beyond the Sponsor’s control, or otherwise. The Sponsor disclaims any liability for entries not received due to technical difficulties or transmission errors. The Sponsor disclaims all liability for any delays, mis-delivery, loss, or failure in the delivery of any item sent by mail, courier, express, electronic transmission, or other delivery method. Released Parties are not responsible for mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, including: failed, incomplete, garbled or delayed transmission of online entries, traffic congestion on telephone lines, the Internet or at any website or lost or unavailable network connections which may limit an online entrant’s ability to participate in the Sweepstakes, and any injury or damage to entrant’s or any other person’s computer or mobile phone related to or resulting from participating in or downloading any information necessary to participate in the Sweepstakes. Released Parties are not responsible for any other errors of any kind, whether computer, technical, typographical, printing, human or otherwise, relating to or in connection with the Sweepstakes, including, without limitations, errors which may occur in connection with the printing or advertising of this Sweepstakes, administration or execution of the Sweepstakes, the cancellation of the Sweepstakes, the processing of entries or in the announcement of the prize or prize winner. Sponsor, in its sole discretion, reserves the right to disqualify any person tampering with the entry process.

Sponsor reserves the right to cancel, modify or terminate the Sweepstakes or any portion thereof for any reason, including if fraud, misconduct, technical or administrative failures destroy or threaten the integrity of the Sweepstakes, in the opinion of the Sponsor/Administrator, or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper conduct of the Sweepstakes as determined by Sponsor/Administrator, in their sole discretion. In the event of early termination of the Sweepstakes, Sponsor reserves the right but not obligation to determine grand prize winner in a random drawing from among all eligible, non-suspect entries received as of the time/date of such termination, or using a different method as solely determined by Sponsor.

IN CASE OF DISPUTES: By participating, each entrant agrees that (1) any and all disputes, claims, and causes of action arising out of or in connection with this Promotion, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court within the State of Florida; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with this Promotion, shall be governed by, and construed in accordance with the laws of the State of Florida, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Florida or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of Florida.

Odds: The odds of winning the Grand Prize are dependent upon the number of entries received.
